ORDINANCE #32

An ordinance for the purpose of promoting health, safety and general welfare by regulating the size, condition and placement of manufactured structures and relocated structures.

The City of Lastrup does ordain:

Section 1.  Definitions

  1. Manufactured home means a structure, transportable in one or more sections, which in the traveling mode, is eight feet or more in width or 40 body feet or more in length, or, when erected on site is 320 or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning, and electrical systems contained therein.
  2. Manufactured Home Building Code means, for manufactured homes manufactured after July 1, 1972 and prior to June 15, 1976, the standards code promulgated by The American National Standards Institute and identified as ANSI A119.1, including all revisions thereof in effect on May 21, 1971, or the provisions of the National Fire Protection Association and identified as NFPA 501B, and further revisions adopted by the State Commissioner of Administration;

Manufactured Home Building Code means, for manufactured homes constructed after June 14, 1976, the manufactured home construction and safety standards promulgated by the United States Department of Housing and Urban Development which are in effect at the time of the manufactured home’s manufacture.

  1. Relocated Structure means any structure previously constructed in whole or in part off site and moved to a new location.
  2. Installation of a manufactured home or relocated structure means assembly, at the site of occupancy, of all portions of a manufactured home or relocated structure, connection of the manufactured home or relocated structure to existing utility connections and installation of a foundation system.
  3. Foundation system means a permanent foundation constructed in accordance with the State Building Code.

Section 2.  Manufactured homes, relocated structures, general provisions

  1. Manufactured homes are prohibited that do not comply with the Manufactured Home Building Code
  2. Manufactured homes and relocated structures are prohibited that are in an unsanitary condition or are in bad repair.
  3. Manufactured homes and relocated structures are prohibited that are structurally unsound or do not protect the inhabitants against all elements.
  4. No manufactured home shall be used for storage or commercial purposes.

Section 3.  Use, placement, size, and installation of manufactured homes and relocated structures.

  1. All manufactured homes and relocated structures used or intended to be used for residential purposes shall be at least 24 feet wide and at least 30 feet long and placed on a foundation system.
  2. All manufactured homes and relocated structures shall conform with applicable land use regulations and set backs.
  3. All manufactured homes and relocated structures used or intended to be used for residential purposes shall be completely installed on a foundation system before they are used.

Section 4. Conditional use permit for manufactured homes and relocated structures

  1. No manufactured home or relocated structure shall be placed or installed within the City of Lastrup unless the city has first issued a conditional use permit.
  2. Application for a conditional use permit shall be on a form prepared by the city, accompanied by a fee set by the city council by resolution, and shall include, at a minimum, the following information
    1. Name and address of applicant
    2. Present location of the manufactured home or structure
    3. Present use of the manufactured home or structure
    4. Date of manufacture or construction of the manufactured home or structure
    5. Intended location of the manufactured home or structure
    6. Intended use of the manufactured home or structure
    7. Dimensions of the manufactured home or structure
    8. A statement that the manufactured home is in conformance with the Manufactured Home Building Code
    9. A statement that the manufactured home or structure is in good repair and condition
    10. The time schedule for completion of installation
    11. A statement that all necessary permits and permissions will be obtained prior to moving the manufactured home or structure.
  3. In granting or denying the application, the city may inspect the structure to determine its condition.  If the manufactured home or structure is found to be structurally unsound, in bad repair, in unsanitary condition or does not provide protection from the elements, the application shall be denied.  If the proposed use or placement of the manufactured home or structure does not comply with land use regulations, the application shall be denied.  The city shall not grant a conditional use permit for a manufactured home which is intended to be used for storage or commercial purposes.  If the manufactured home or structure does not comply with the size and use limitations of this ordinance, the application shall be denied.

In granting an application for a conditional use permit, the city will review the condition and appearance of the manufactured home or structure and may set such conditions as are necessary to require conformance to existing homes and structures in the proposed location.The city may set conditions for completion of installation and landscaping.

Prior to issuing a conditional use permit, the city shall set a time and place for a hearing.All property owners and residents within 300 feet of the proposed location shall receive notification at the property address or at the tax payer’s address as maintained in the records of the Morrison County Auditor.The city shall cause 10 days notice of the hearing to be published in the official newspaper.All interested parties shall be given opportunity to address the council at the hearing.

  1. Violation of the terms of a conditional use permit shall be considered a violation of this ordinance and the land use regulations of the City of Lastrup.  The city may, at its option, and without limitation
    1. Enter onto the property to correct the violation and assess the cost therefore as a special assessment
    2. Commence proceedings at law or equity to abate the violation
    3. Initiate criminal prosecution
    4. Commence any other proceeding to enforce its ordinance.

Section 5.  Violation a misdemeanor.  Violation of this ordinance shall be punishable as a misdemeanor.
