An ordinance regulating and controlling the growth of weeds and grass in the city of Lastrup, Minnesota

The City of Lastrup, Minnesota, in council convened, ordains as follows:

Section 1Cutting and removal of weeds and grass

It shall be unlawful for any owner, lessee, or occupant having control of any occupied or unoccupied lot or land in the City of Lastrup to permit on any such lot or land in the City of Lastrup to permit on any such lot or land 10 feet outside the property line if there is no curb and to the middle of the alley, any growth of weeds or grass to a greater height than 6 inches on the average.

Section 2.  Duty of owner, lessee or occupant

It shall be the duty of any owner, lessee or occupant of any lot or land to cut all such weeds and grass as often as necessary to comply with Section 1.  Cutting the weeds and grass at least once in every three weeks between May 15, and September 15 shall be deemed to be a compliance with this ordinance.

Section 3.  When city to do the work 

If the provisions of the foregoing sections are not complied with, the City shall have the authority to cut the weeds or grass.  The cost of such cutting plus 5% for inspection and other additional costs in connection therewith, shall be certified by the city Clerk to the county auditor and shall become a lien upon the property in which the weeds and grass were located and shall be added to and become a part of the taxes next to be assessed and levied upon such lot or land and shall bear interest at the same rate as taxes and shall be collected and enforced by the same officer and in the same manner as taxes.

Section 4.  Penalty

Any person who shall violate any provision of this Ordinance or who shall resist or obstruct the city in the cutting of weeds and grass as stated in this ordinance, upon conviction shall be subject to a fine of not more than $100 and each day on which violation continues shall constitute a separate offense.

Section 5.  Definition

The word “person” as used in this ordinance shall mean and include one or more persons of either sex, corporations, partnerships, associations, joint stock companies and all other entities of any kind capable of being sued.
